A lot of people think that if they give assets away they do have to wait five years before they can get on Medicaid, and that may not necessarily be true. Because with medicaid, there are certain assets that are called countable and some that are non countable, and also, depending on who you give assets away to can determine if you have to wait in order to qualify for Medicaid. So the answer is: it really depends. Because it’s what you give away to whom you give away, and even if you give away assets that Medicaid would consider as an improper transfer, then an elder law attorney can look at your situation and we can determine if there’s a way to either get all of those assets back or partial assets back, which, again, wouldn’t require you to wait an entire five year period, which is the lookback period for Medicaid.
